RE-EXPORT BOND

   

To,

   

The President of India,

Through Deputy Commissioner of Customs, New Custom House,

   

WHEREAS M/s …………….. having its office ………………. (hereinafter referred as the importer) which expressions shall include its successors/biers/executors/administrators and legal representatives has received a jobbing order No. …….dated ----------- from Robespierre Inc. … (hereinafter referred to as a supplier) Whereas the importer has received goods free of cost for Rs ................................................. .................................. for execution of said jobbing order.

   

WHEREAS the goods have arrived and the importer seeking the duty free custom clearance of the inputs under Customs Notification No 32/97 Customs dated...................

   

Now this bond witness as follows:

   

1.  The inputs aforesaid (Invoice no.-GF06J3AM5172) dated................. have been imported by the        Importer for execution of the jobbing order placed with it by the supplier of the materials.

   

2.  That the importer shall re-export the goods except wastage after carrying out the necessary jobbing work within the period prescribed in the Customs Notification referred above.

   

3.     That the Importer undertake that the value addition on re-export shall not be less than 10% and confirm    and declares that the value addition of appx. 100% will be achieved in the execution of the jobbing order.

   

4.   That the importer undertakes to observe, adhere and to comply with all the terms and conditions of the Customs Notification No. ……. Customs dated ............... and Export Import Policy 2002-2007 including the input output Norms and Rules/ Orders/ Notifications made there under.

   

5.   That the importer shall use the inputs imported wholly and solely for the execution of the said jobbing order and that shall be no misuse of the inputs so imported.

 

6.                 That the importer shall furnish a certificate from the nationalized/ schedule bank in original showing realization foreign exchange against export in the goods made in the fulfillment of the expert obligation copies of Shipping Bills Airway Bins/Bill of landing customs authenticated invoices and such other documents as may be demanded by the customs.

   

   

7.                 Authorities in evidence in support of the export and foreign exchange earned in
fulfillment of the terms and conditions of this bond.

   

   

8.   That in the event of default by the importer to perform its export obligation or to realize the foreign exchange aforesaid or of any other condition of this bond, the importer shall be liable to pay the Govt./ Customs Authorities the amount Of duties saved Rs ........................................................................... together with interest leviable as per Customs Act, 1962 and the Import-Ex port Policy.

   

   

   

   

   

   

   

   

 

9.   That the importer undertakes that in the event of non-fulfillment of the export obligation the importer shall upon instructions of the Govt. hand over the imported goods to the Customs Authorities or to any other agency nominated by them for disposal in any manner and the amounts be realized maybe appeariated by the Govt. towards fulfillment of the export obligations/payment of customs duty fine or penalty and the expenses incurred by the agency.

   

   

10.   That the payment of amount demanded by the Govt. under this bond for failure to comply with any of the terms and conditions of this bond will not effect the liability of the importer to any other action including the initiation of legal proceedings for confiscation of the imported material and other penalties, liabilities and consequences under the provision of the Customs Act, 1962 and the Foreign Trade Development and Regulation Act, 1962 and other rules made here under or under any other law of the land that may be applicable

   

   

11. That the importer irrevocably undertakes to secure the performance of export obligation and other terms and conditions under this bond by execution of a Bank Guarantee for an amount of Rs. ........................................................................ and in the manner to the satisfaction of the Customs Authorities.

   

   

12.  That an account of consumption will be submitted at the time of export an also declare that the sample drawn at the time of import material will be sealed and hand over to the proper authorities for comparison with export product.
