We M/s ……………………………………………….. do hereby agree and undertake for ourselves and our successors assigns to indemnify and keep you and/or successors and assigns to indemnify against all claims, losses, demands, damages and costs of any nature whatsoever that may be made on you by anybody in any capacity or sustained or incurred by you inconsequence of you having executed the said indemnity bond and we hereby agree and confirm to abide by the following terms and conditions:

1                    The shipper/consignee and/or their clearing agents, container/transporters and/or their employees and servants shall take all reasonable care to ensure that the containers are kept in a suitable and usable condition for all of whose acts of omission and commission the shipper/consignee is solely liable.

2                    The shipper/consignee agree to indemnify the carrier and/or the agents (above named) against and or all losses, damages, liability, cost or expenses possession of the shipper/consignee, arising our of our while connected with injury or death of persons of loss or damage to property or other persons in the course of such movement and stuffing/destuffing operations.

3                    The shipper/consignee shall return the container in as sound conditions as earlier delivered and for failure to do so will be liable for cost and repair and damage for this purpose survey by M/s   …………………… is agreed and their report and finding shall be binding on the shipper/consignee.

4                    The shipper/consignee are liable to indemnify the carrier or its agents for claim by the customs to the extent of Rs.1, 00,000/- (Rupees One Lacs Only) per 20` each container and double for 40` each container.

5                    The guarantee under these presents shall be effective from the time the container is delivered to the shipper/consignee or their representative till the same is returned to the Delhi , ICD area and delivered against agencies clear receipt and discharge.

6                    If this container is not received by the carrier within the period allowed, we will be liable for demurrages as follows:

$48/- per day each 20` container

$96/- per day each 40` container
