In consideration of your allowing us to remove the mentioned importable full containers to our premises at …………………………………………………………………………..

We the undersigned hereby undertake and guarantee you the following:

1                     We shall at our cost and risk remove the above containers (after payment of customs duty) from nominated site to our premises and return the same to your storage yard within 15 days from the date of its removal.

2                     We shall at our cost arrange to survey the container/s by your surveyors before removal from the nominated site and after the empty are returned at your storage yard.

3                     In case of the damage to the containers whilst in our custody, we shall pay the repair cost of damage as estimated by your surveyors.

4                     We shall pay you the container detention charges and other charges as and when demanded by you.

5                     In case we fail to return the container/s within 15 days from the date of removal we shall obtain necessary permission from you and custom authorities to retain the container/s with us beyond 15 days.

6                     In case the container/s is / are lost whilst in our custody we shall pay you the cost of the container/s and the custom duty applicable on the container/s i.e. Rs.272000/- per 20` and Rs.544000/- per 40` container.

7                     We shall produce the original triplicate copy of the bill of entry duly endorsed by the gate officer at the storage yard within 7 days from the date of return of the containers along with survey reports.

8                     We shall keep you and the carriers completely indemnified and harmless from and against all consequences which may arise from your complying with our request.

9                     This bond will remain in force till such time we comply with our above undertaking and fulfill all your customs authorities requirements.

10                  We hereby confirm that the import cargo does not contain any contraband and articles in terms of Indian custom regulation and that the shippers have not tampered with the purpose of concealment of any contraband cargo.

In the event of custom or any other Govt. Authorities discovering that there has been violation in this respect. We as consignee of the cargo would be fully responsible for all the cost and consequences for the same. We further confirm that the containers would be taken to our premises and that we would approximately take 5 days to return the empty container back to your storage yard after removal from the nominated site.
