In consideration
of your allowing us to remove the above mentioned import loaded containers to our
premises. The undersigned hereby undertake and guarantee you the following:-
1
We shall at our cost and risk remove the
above container/s (after payment of Custom Duty) from nominated site of our premises
situated at ……………… …….……………………………………………………and return the same to your storage yard
within one month from the date of its removal.

We shall at our cost arrange to survey
the container/s by your surveyors before removal from nominated site and after returning
at your storage yard.

We shall at our cost arrange to survey
the container/s and we shall pay the repair cost of damage as estimated by your
surveyors, while the container was in our custody.

We shall pay you the container detention
and other charges, as and when demanded by you.
5
In case we fail to return the container/s
within one month from the date of removal, we shall obtain necessary permission
from you and custom authorities to retain the container with us beyond 30 days.
6
In case the container/s is/are not lost
while in our custody, we shall pay you the cost of container/s and the custom duty
applicable on the container/s Rs.253000/- per 20` and Rs.421000/- per 40` container.
7
We shall produce the original/duplicate
copy of bill of entry endorsed by customs within 7 days from the returning the container/s
along with survey reports.

We shall keep you and the carriers completely
indemnified and harmless from and against all consequences which may arise from
your complying with our request.

This bond will remain in force till such
time we comply with our above undertaking and fulfill all your/customs authorities
requirements.
10 We hereby confirm that
the import cargo does not contain any contraband articles in terms of Indian Regulations
and that the shipper has not tampered with container/s for the purpose of concealment
of any contraband cargo in the event customs or any other authority discover that
there has been violation in this respect, we as consignee of this cargo would be
fully responsible for the container & would take 5 days to return the container
back to your empty storage yard after removal from the nominated site.
11 Consequent to the movement
of the container/s to the Factory, we hereby indemnify the carrier and their assigned
agents towards any loss, damage, liability, cost of expenses suffered and incurred
by the movement of the said container under your jurisdiction arising out of either
loss/death of the person or damage to the property of other person/s arising out
of the use /operation maintenance in the possession of carriers container/s by the
consignee or this authorized representative.
